Please read these Terms of Service carefully before using the Dibs mobile application or any related services. By creating an account or using Dibs, you agree to be bound by these terms. If you do not agree, do not use the app. These terms constitute a legally binding agreement between you and Dibs Technologies Inc., a company incorporated in Ontario, Canada.
By downloading, installing, or using the Dibs application (the "App") or visiting dibsrun.com (the "Site"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), as well as our Privacy Policy, which is incorporated herein by reference.
You must be at least 18 years of age to create an account or use Dibs in any capacity. By using the App, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement. Dibs does not knowingly permit users under the age of 18.
If you are using Dibs on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms, and "you" refers to that entity.
Dibs reserves the right to update these Terms at any time. We will provide at least 14 days' advance notice of material changes via email to the address on your account. Continued use of the App after the effective date of updated Terms constitutes acceptance of those changes.
Dibs is a technology platform that connects three types of users for same-day local delivery of secondhand and marketplace items:
A single user account may participate in all three roles.
Dibs is a platform, not a delivery company or retailer. We do not own, inspect, warehouse, or take possession of any items listed or sold through the App. We do not employ Runners. We are not a party to the transaction between Buyers and Sellers, and we are not a party to the delivery agreement between Buyers/Sellers and Runners. Dibs provides the technology, payment processing infrastructure, and platform rules that facilitate these interactions.
The App is currently available on iOS and is in early access. Features, pricing, and availability may change as the platform develops.
To use Dibs, you must create an account by providing a valid email address and such other information as the App requires. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
You are permitted one account per person. Creating multiple accounts to circumvent suspensions, restrictions, or platform fees is strictly prohibited and may result in permanent termination of all associated accounts.
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify Dibs immediately at support@dibsrun.com if you suspect unauthorized access to your account. Dibs is not liable for any loss resulting from unauthorized use of your account where you have failed to take reasonable steps to protect your credentials.
Dibs reserves the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or poses a risk to other users or the platform.
When you place an order through Dibs, you make a purchase offer to the Seller at the listed price, plus a delivery fee paid to the Runner, plus any applicable taxes. The Seller retains the right to accept or reject your order. An order is confirmed only once the Seller accepts it and a Runner is assigned.
Payment AuthorizationBy submitting an order, you authorize Dibs to charge your payment method for the full order total, which includes the item price, the delivery fee, and any applicable taxes. Payment is processed at the time of order placement through our payment processor, Stripe. All amounts are in Canadian dollars unless otherwise stated.
No Chargebacks Without Contacting Support FirstIf you have a concern about a charge, you agree to contact Dibs support at support@dibsrun.com before initiating a chargeback or dispute with your card issuer or bank. Dibs will make reasonable efforts to resolve the issue promptly. Initiating a chargeback without first contacting Dibs support may result in account suspension and may affect your eligibility for Buyer Protection.
CancellationsYou may cancel an order at no charge at any time before a Runner has been assigned to the job. Once a Runner accepts and is en route to the Seller, cancellation is no longer available through the App. If you believe you have exceptional circumstances, contact support. After delivery is confirmed, the sale is final subject to the Buyer Protection terms in Section 9.
Buyer ProtectionDibs offers Buyer Protection as described in Section 9 of these Terms. Buyer Protection is your primary recourse in the event of a delivery issue or item dispute.
You agree that all listings you create on Dibs will accurately and completely describe the item, including its condition, any defects, dimensions where relevant, and all photos representing the actual item being sold. Misleading, inaccurate, or fraudulent listings are strictly prohibited and may result in account suspension, forfeiture of earnings, and legal liability.
Item AvailabilityBy listing an item, you represent that the item is in your possession and available for pickup at the time an order is placed. If an item is sold or becomes unavailable through another channel, you must immediately remove or deactivate the listing on Dibs. Repeated failures to have items available when a Runner arrives may result in strikes against your account and eventual suspension.
Order Approval and RejectionYou will receive a notification when a Buyer places an order for your item. You have a limited window to accept or reject the order. If you accept, you are committing to have the item ready for pickup at the address on file. If you reject or fail to respond within the allowed time, the order will be automatically cancelled and the Buyer will receive a full refund.
Payout TimingAfter delivery is confirmed by the Runner and Buyer, your earnings are held during a 30-minute Buyer Protection window. If no dispute is filed within that window, your payout is released to your connected Stripe account. Typical bank transfer time is 1–2 business days after release. You may be eligible for instant cashout subject to your Stripe account status.
Platform FeeDibs charges a 10% platform fee on the item sale price (excluding delivery fee and taxes). This fee is deducted automatically before your payout is issued. There are no listing fees or monthly subscription fees — you only pay when you successfully sell.
Runners are independent contractors, not employees, agents, or partners of Dibs. Nothing in these Terms or your use of the App creates an employment, agency, joint venture, or partnership relationship between you and Dibs. As an independent contractor, you are responsible for your own taxes, expenses, vehicle costs, insurance, and any other obligations that arise from performing deliveries. Dibs does not withhold income tax, remit employment insurance premiums, or make Canada Pension Plan contributions on your behalf.
Age and Identity VerificationAll Runners must be at least 18 years of age. You are required to complete identity verification within the App, which may include uploading a valid government-issued photo ID. Dibs reserves the right to reject or suspend Runner accounts that fail verification or provide fraudulent identification.
Delivery ResponsibilitiesBy accepting a delivery job, you agree to: (a) pick up the item from the Seller's address as listed; (b) handle all items with reasonable care; (c) deliver the item to the Buyer's address in the same condition as received; (d) use the in-app confirmation code process at both pickup and drop-off; and (e) behave professionally and respectfully toward Sellers and Buyers at all times.
You are responsible for your own conduct during deliveries, including compliance with all applicable traffic laws and regulations. Dibs is not liable for any incidents, accidents, or losses that occur during a delivery beyond what is covered by platform policies.
Earnings and CashoutRunners keep 100% of the delivery fee for every completed job. The delivery fee is shown to you before you accept any job — there are no hidden deductions. Earnings are released after the Buyer Protection window closes. Instant cashout to your connected bank account is available subject to your Stripe Express account eligibility.
Right to DeclineYou may decline any delivery job at any time before accepting it. Once you have accepted a job and are en route, you should complete the delivery. Repeated mid-job cancellations after acceptance may negatively affect your runner standing on the platform.
You agree not to use Dibs for any of the following purposes, and not to facilitate others in doing so:
Violation of these prohibitions may result in immediate account suspension, forfeiture of pending earnings or refunds, and where appropriate, referral to law enforcement authorities.
All payments through Dibs are processed by Stripe, a third-party payment service provider. By using Dibs, you agree to Stripe's terms of service and privacy policy in addition to these Terms. Dibs collects the total order payment from the Buyer and then distributes the appropriate amounts to the Seller (item price less the platform fee) and to the Runner (delivery fee) upon successful completion of the delivery.
Finality of SalesAll sales are final once delivery is confirmed by the Runner and Buyer via the in-app confirmation code, unless a Buyer Protection claim is filed within 30 minutes of delivery confirmation (see Section 9). After this window closes, the transaction is considered complete and no refund or return is available through Dibs.
TaxesPrices displayed in the App may be subject to applicable sales taxes (including HST/GST) which will be calculated and displayed at checkout. You are responsible for any taxes applicable to your transactions under applicable law. Dibs does not provide tax advice.
RefundsRefunds are issued in accordance with the Buyer Protection policy in Section 9, or at Dibs' sole discretion in cases of platform error. Refunds are processed back to the original payment method and typically appear within 3–5 business days, depending on your bank or card issuer.
Dibs offers Buyer Protection to give Buyers confidence when purchasing through the platform. The following protections apply:
Item Not DeliveredIf your order is confirmed as accepted but the item is never delivered — for example, the Runner fails to complete the delivery or the order is cancelled after pickup — you are entitled to a full refund of the total amount charged, including the delivery fee.
Item Significantly Not as DescribedIf you receive an item that is materially different from what was described in the listing (e.g., wrong item, undisclosed major damage, or fundamentally different condition), you may be eligible for a partial or full refund at Dibs' discretion, based on the nature of the discrepancy. To be eligible, you must file a claim within 30 minutes of delivery confirmation through the order detail screen in the App, or by contacting support@dibsrun.com with your order number and photos of the issue.
Claim WindowAll Buyer Protection claims must be initiated within 30 minutes of the delivery being confirmed in the App. Claims filed after this window will not be eligible for Buyer Protection. This window exists to facilitate same-day resolution while all parties are still available.
RatingsAfter each completed delivery, Buyers are invited to rate both the Runner and the Seller. Ratings inform the platform's trust and safety systems and help other Buyers make informed decisions. All ratings must be honest and based on your direct experience.
ExclusionsBuyer Protection does not cover: change of mind after delivery, items damaged after delivery is confirmed, disputes about price (unless the wrong amount was charged), or items that were accurately described but not to the Buyer's satisfaction.
To the maximum extent permitted by applicable law, Dibs and its directors, officers, employees, contractors, and agents shall not be liable for:
In any event, Dibs' total aggregate liability to you for any claim arising from your use of the App shall not exceed the greater of: (a) the total fees paid by you to Dibs in the 30 days preceding the claim, or (b) CAD $100.
Some jurisdictions do not permit the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the above limitations apply to the fullest extent permitted by law. Nothing in these Terms limits Dibs' liability for fraud, gross negligence, or any other liability that cannot be excluded by law in the Province of Ontario.
If you have a dispute with Dibs, another user, or a transaction, you agree to first contact Dibs support at support@dibsrun.com and make a good-faith effort to resolve the dispute informally. Dibs will respond within 5 business days and will work with you to find a reasonable resolution.
Binding ArbitrationIf a dispute cannot be resolved informally within 30 days of first contacting support, both parties agree to resolve the dispute through binding arbitration administered by a recognized arbitration body in the Province of Ontario, in accordance with its commercial arbitration rules. The arbitration shall be conducted in English in Toronto, Ontario, unless the parties mutually agree to another location or virtual proceeding. The arbitrator's decision shall be final and binding on both parties.
You and Dibs each waive the right to a jury trial and the right to participate in a class action lawsuit or class-wide arbitration. Each party must bring claims individually.
ExceptionsNotwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction in Ontario to prevent the misuse of intellectual property or confidential information, or to prevent irreparable harm.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
To the extent that any dispute is not subject to arbitration under Section 11, you agree to submit to the exclusive jurisdiction of the courts of the Province of Ontario for the resolution of any such dispute. You waive any objection to the laying of venue in Ontario.
Dibs reserves the right to modify these Terms at any time to reflect changes in our platform, operations, or applicable law. For changes that are material to your rights or obligations, we will provide at least 14 days' advance notice via email to the address associated with your account, and we will update the "Last updated" date at the top of this page.
Non-material changes (such as typographical corrections, reorganization of content, or clarifications that do not alter your rights) may take effect immediately upon posting.
If you do not agree to updated Terms, you must stop using the App before the effective date of the changes. Your continued use of Dibs after the effective date constitutes your acceptance of the updated Terms.
